TEXARKANA, Ark. – An Arkansas man claims that diabetes pill Avandia caused him to suffer a heart attack. Kenneth L. Bryan, 58, has filed a personal injury lawsuit against GlaxoSmithKline on November 18 in the Texarkana Division of the Western District of Arkansas. Bryan says he had not had any health problems apart from diabetes. He says he was given a clean bill of health in December 2003, when he started taking the prescription drug Avandia. Bryan had a heart attack in December 2005, which he believes was caused by the drug. Since then he has not been using Avandia. Bryan underwent four bi-pass surgeries, multiple angioplasties and stints. Bryan argues that the medication was not fit for the purpose for which it was meant for. The plaintiff claims that Glaxo violated the implied warranty of fitness and directly caused his injuries. Bryan is seeking more than $75,000 in damages for medical costs, loss of earnings and earning capacity, pain and suffering, interests and legal costs.
