Barker & Little Settles Lead Poisoning Lawsuit |

A personal injury lawsuit between landlord Barker & Little and a former tenant has been settled out of court, said 7th Circuit Court Judge A.P. Pete Fuller. The settlement amount has not been disclosed. According to Fuller, he signed documents to close the case and seal the file. Former tenant Jonathan Quinn and his wife Tammy Fasching initially named seven Barker & Little corporations, all owned by Douglas Hamilton, in the civil lawsuit they filed on behalf of their daughter Hailey Quinn. Hailey Quinn became ill with lead poisoning during 2005 summer when she was less than 3 years old. It was approximately 18 months after the family shifted to an apartment at 816 St. Joseph St., owned by Barker & Little. Doctors found Hailey’s illness was caused by lead poisoning and suggested the family not to return to the same apartment, according to the complaint filed by the couple in 2006. In the lawsuit, the family claimed Hamilton knew the apartment had been painted in the past with high-lead paint, and the paint in the apartment was peeling, flaking and causing lead-filled dust. Hamilton failed to remove the danger and also failed warn the family that the deteriorating paint was fatal, according to court documents. In last July, the family had offered to settle the suit for $150,000, but Hamilton was not ready to accept that offer.
