Company agrees to pay unpaid overtime |

Quicksilver Express Courier Inc., a St. Paul, Minnesota based company, has agreed to pay $590,039 in unpaid minimum wage and overtime pay to 950 workers after a U.S. Labor Department investigation found that the company violated the Fair Labor Standards Act. The company has offices in Kansas City, Kansas; St. Paul; Phoenix; Lakewood, Colo.; and West Allis, Wis. “Drivers in the Kansas City employed by the company between April 2006 and April 2008 are entitled for the payments,” said Brad Mitchell, a Labor Department spokesman. According to Mike Crary, the CEO of Quicksilver, the company has 75 workers at its Kansas City and 60 of them are drivers. Fifty five of the drivers received a sum of approximately $30,000 in back pay and overtime through the settlement. Wage and Hour Division of the agency found that the company made deductions from drivers’ pay for employer-required insurance and computer/GPS systems, which resulted in minimum wage violations. The company excluded bonuses from employees’ regular pay rates and offensively classified drivers as exempt, resulting in overtime pay violations. Per Fair Labor Standards act (FLSA), employers are required to pay employees the federal minimum wage, at present $6.55 an hour, for all hours worked, and time and a half for hours worked more than 40 hours a week.
