Former Employee Sues KCS over Benzene Exposure |

A former Kansas City Southern Railway Co. (KCS) employee is suing the company claiming that he was exposed to benzene and other carcinogens all through his career. Richard Czuprynski has filed a lawsuit against KCS on 4th August in Jefferson County District Court. According to the complaint, Czuprynski was exposed to benzene, benzene-containing chemicals, xylene, toluene, other mixed solvents and diesel exhaust while working as an engineer, brakeman and conductor for KCS from 1976 through March. The suit states that Czuprynski developed Non-Hodgkins Lymphoma as a result of his exposure to the pollutants. Non-Hodgkins Lymphoma is a cancer of the immune system whereby cells in lymph nodes peculiarly reproduce which ultimately leads to tumors that spread all over the body. In consequence of his cancer, Czuprynski experienced physical pain, suffering, mental anguish, lost earnings and benefits, physical impairment and disfigurement. He incurred huge medical expenses as well, the complaint says. Czuprynski alleges that KCS failed to provide him with a safe working environment, failed to limit his exposure to harmful substances, failed to warn him of the hazards of exposure to the substances and failed to provide him with sufficient protective equipments. Czuprynski is seeking unspecified amount of damages in addition to costs and any other relief to which he may be entitled. Judge Milton Shuffield of 136th District Court will be hearing the case.
