Former Employee Sues Novartis over Unpaid Wages

CHARLESTON – A former employee of Novartis Pharmaceuticals is suing the company for allegedly violating the West Virginia Wage Payment and Collection Act.

Timothy Atchison, from Putnam County, has filed a complaint on 14th December in Kanawha Circuit Court.

According to the complaint, Atchison was an employee of the company for more than 2 years. He worked for the company from May 2008 until September 2010, the lawsuit states.

The plaintiff argues that the company failed to pay his due remuneration at least once in every two weeks and thus violated the state regulation. Atchison also claims that the company failed to pay his final wages within 72 hours as required by the law.

According to the complaint Novartis only paid the plaintiff one time per month.

Atchison is seeking compensatory as well as punitive damages with pre- and post-judgment interest at legal rate.

Circuit Judge Carrie Webster will preside over the case.
