Former Employees Sue Home Depot over Unpaid Overtime

Chicago, IL – Three former employees of Home Depot, the largest U.S. retailer of home improvement and construction products and services, are suing group claiming that they were not paid overtime wages for past three years.

It is a group of former assistant managers of an Illinois Home Depot store that filed the lawsuit on Tuesday, July 21, 2009 in the Circuit Court of Cook County.

Home Depot operates 2,193 stores across all 50 U.S. states, Canada, Mexico, and China.

The plaintiffs accuses that Home Depot intentionally misclassified them as managers to exempt them from overtime payment. The suit states that the plaintiffs were illegally denied earned wages as the retailer required them to work up to 55 hours a week. The plaintiffs were never issued any payment for the time they worked over 40 hours, the suit states.

The plaintiffs also argue that Home Depot has policies to terminate assistant store managers and decrease their salaries if they fail to work the required 11-hour minimum shift in which they were regularly scheduled.

According to the plaintiffs, this is a usual practice at the 57 Illinois Home Depot centers, which affected all of their assistant managers within the last three years.

According to the Fair Labor Standards Act (FLSA), employees should be given overtime payment for hours worked in excess of 40 in a workweek of at least one and one-half times their normal rate of pay.

Home Depot officials said they could not comment on the issue as they have not seen the lawsuit yet.
