A Texas attorney is suing GlaxoSmithKline (GSK) for marketing and selling Avandia though the company aware of its hazards. A personal injury-product liability lawsuit has been filed June 3 in the Beaumont Division of the Texas Eastern District Court on behalf of Charley Elizondo. Elizondo is a Type 2 diabetic. He argues that the use of prescribed drug Avandia has worsened his condition. Avandia is an FDA approved drug, which is used as an oral anti-diabetic agent that acts mainly by rising insulin sensitivity. According to the lawsuit, GSK unfairly convinced the FDA to approve its drug. GSK then marketed the drug though the company officials were aware of the hazards linked to it, the lawsuit states. In 2007, the New England Journal of Medicine had published a study confirming the link between Avandia and heart attack, the lawsuit states. Elizondo argues GSK concealed the proofs given in the study so that their sales won’t be diminished. The suit blames GSK for negligently and recklessly failing to warn the general public of the risks associated with taking Avandia, product liability, selling a defective drug, failing to provide sufficient warnings, fraud, negligence, misrepresentation and wrongful death. U.S. District Judge Thad Heartfield will be presiding over the case. The plaintiff is seeking a compensation of $76,000.00 for past and future medical expenses and mental anguish.
