Man files personal injury lawsuit against physical therapist

TEXARKANA – A man filed a personal injury lawsuit in the Texarkana Division of the Eastern District of Texas on January 4, claiming he suffered an extra injury to his right shoulder as a result of his physical therapist’s undue and forceful manipulation of his arm.

According to James Marshall, the manipulation did not conform to the accepted standard of physical therapy. Marshall is suing Christus Health Ark-La-Tex, doing business as Christus St. Michael Rehabilitation Hospital, for medical negligence. Marshall alleges that the hospital violated its duty to treat its patients without causing additional injury.

According to the lawsuit, Marshall was receiving physical therapy for fractured ribs on May 28, 2009, and the physical therapist injured his right shoulder in an attempt to manipulate his arm during his treatment.

Marshall argues that the hospital negligently breached the duty of care it owed to him and failed to exercise the right degree of care, skill and supervision that the hospitals and physical therapists should implement.

Marshall is seeking more than $75,000 in damages for past and future pain, suffering, mental anguish, medical care and expenses, loss of earnings, loss of earning capacity, and disfigurement.
