CHARLESTON - Joseph M. Hutchison, a Monongalia County man, has filed a lawsuit in Kanawha Circuit Court against 79 companies after developing deadly asbestos-related diseases asbestosis and mesothelioma. The suit was filed on behalf of Hutchison and his wife, Ann Hutchison, on June 6, by attorney David P. Chervenick. Joseph Hutchison was working as a laborer at Union Carbide in South Charleston. He was also a student and faculty member at West Virginia University. The lawsuit claims that Hutchison has developed both asbestosis and mesothelioma. According to the lawsuit, Hutchison was exposed to deadly asbestos fibers from the products used on his worksites, which were situated across West Virginia. The only known reason for mesothelioma is asbestos exposure. The disease is incurable. Ann Hutchinson argues that she lost the financial backing, services, companionship and society of her husband. The case will be allocated to a visiting judge. Hutchison is seeking punitive as well as compensatory damages in the 15-count suit; not only for themselves, but also for others equally situated.
