Man Sues Nursing Staff in Wrongful Death Case

A deceased woman’s husband is suing the nursing staff at a service of Memorial Hospital in Belleville, alleging the nurses were guilty of a number of negligent acts.

According to Cletus Schmittling, his wife was a Memorial Convalescent Center in Belleville when she presented with symptoms of a respiratory infection.

In her pre-surgery assessment, Carole Schmittling told nurses that

The complaint filed February 10 in St. Clair County Circuit Court states that she had just gotten over an upper respiratory infection, the complaint filed Feb. 10 in St. Clair County Circuit Court states. Nurses also found that Carole Schmittling’s blood oxygen level gradually decreased from 97 percent to 92 percent after admitted in the hospital, according to the lawsuit.

Carole Schmittling complained of coughing up blood during the evening of January 25, 2008. She was too fatigued to perform physical therapy on January 24, 25 and 26. She didn’t feel well at all on January 25 and 26. She complained that she felt her respiratory infection returning on January 26. On January 25, she had a temperature of 99.5 degree which increased to 100 degrees on January 26, the lawsuit states.

Cletus Schmittling states that he complained to staff that his wife was not feeling well and was unable to breath well on January 26, 2008. According to the complaint, the nursing staff negligently failed to test Carole Schmittling’s blood oxygen saturation; to report it to her treating physician; to report the signs and symptoms as Carole Schmittling passed on to them; to attend the signs and symptoms of Acute Respiratory Distress Syndrome(ARDS); and to treat the ARDS. As a result of negligence of the nursing staff, Carole Schmittling died on February 12, 2008, at Memorial Hospital, the complaint states.

Cletus Schmittling argues he lost her wife’s love, affection, companionship, support and services on account the death of Carole Schmittling.

The names specified in the four-count lawsuit include Josefina Nance and Cathy Allen.

Cletus Schmittling is seeking compensatory damages of more than $150,000 and any other relief to which he may be entitled.
