A Louisiana man is suing Yogiji Hospitality, claiming that he was injured as a hotel shower bench collapsed when he sat on it.

James Deville filed a lawsuit against Yogiji on 17th May in Jefferson County District Court.

According to Deville’s complaint, he checked into a room at La Quinta Inn and Suites Houston-Normandy location on February 7, 2009. The complaint states that the room had a handicapped accessible restroom and shower, which had a bench in it that fastened to the tile wall of the shower.

Deville sat down on the bench while taking a shower, the complaint says. The bench came out of the wall all of a sudden, causing Deville injury to his face, neck, back and knees as he collapsed to the floor. The injuries required surgical intervention on his knees from an orthopedic surgeon, according to the lawsuit.

Additionally, Deville argues that he suffered physical as well as mental anguish, lost his earning capacity, sustained disfigurement and physical impairment and incurred medical expenses.

Deville believes the shower bench and its parts either failed, were improperly installed or were improperly inspected which is why it failed to remain in the wall.

Yogiji is being sued for breach of express and implied warranty and strict liability.

Deville is seeking compensatory and exemplary damages, in addition to court expenses, pre- and post-judgment interest and other relief to which he may be entitled.

Judge Donald Floyd, 172nd District Court, will be presiding over the case.
