Texas Driver Sues Employers over Unpaid Overtime

SHERMAN – A Texas truck driver has filed a lawsuit against his former employers in order to recover his unpaid overtime compensation.

In his lawsuit, Clinton Roberts alleges that his former employers International Trucking Solutions Inc. and Gregory Hewitt violated Fair Labor Standards Act by failing to pay his overtime wages properly. Fair Labor Standards Act is meant to prohibit the denial of overtime compensation for hours worked in addition to forty per workweek.

The lawsuit was filed on 22nd March in the Sherman division of the Eastern District of Texas.

According to the lawsuit, Roberts worked for the defendants from June 2007 through December 2008. Roberts claims that the defendants didn’t pay him one and one-half times his regular rate of pay for each overtime hour worked.

Robert’s complaint accuses the defendants of willful violation of the Fair Labor Standards Act.

Roberts is seeking actual and compensatory damages including the sum of overtime that he was not paid, in addition to damages for interest, court costs, and attorney’s fees.
