Woman Files Wrongful Death Suit Against Drugmaker |

CHARLESTON – A woman from Ohio has filed a wrongful death suit against West Virginia based Mylan Pharmaceuticals and Mylan Inc. on behalf of the estate of her late husband, who allegedly died from an allergic reaction to the company’s product Phenytoin. Amy Clanton filed the suit in Kanawha Circuit Court on May 9. Her husband was prescribed Phenytoin, a drug that helps to control seizures. According to the lawsuit, Clanton noticed skin disruptions on his body and his entire eyelid peeled off as his wife placed drops in his eyes after using the product for some weeks. Ralph Clanton was admitted in Miami Valley Hospital in Dayton and diagnosed with toxic epidermal necrolysis resulted from Dilantin, the brand name for Phenytoin. The lawsuit accuses that Clanton died on May 27, 2006 as a result of his intake of Phenytoin. The suit also alleges that Mylan has reaped huge profits by concealing the potential hazard associated with the ingestion of Phenytoin from the public. “My husband would not have taken Phenytoin if he had known of the risks and hazards associated with the drug,” Amy Clanton said. The case has been assigned to Judge Paul Zakaib. Clanton is claiming for punitive and compensatory damages to cover her husband's injuries, pain and suffering, as well as the damages to his estate.
