Woman Sues Care Center for Negligence |

GALVESTON – A woman from Matagorda County is suing Harborview Care Center claiming that the nursing home is responsible for the death of her mother. Lynda Calloway of Sargent has filed a civil liability lawsuit on August 31in Galveston County District Court, alleging that Harborview failed to properly look after her mother Doris Beard who died on June 18, 2008. It was on October 1, 2007 that Beard was admitted in the care center. She resided there until April 28, 2008, according to the lawsuit. Calloway alleges that Harborview continually violated the law by failing to ensure and provide proper nursing care to Beard. According to the lawsuit, Beard suffered from bedsores, dehydration and malnutrition. The suit states that the care center failed to implement appropriate infection control procedures, failed to intervene with proper medication, failed to treat Doris Beard for pain, and failed to inform Doris Beard’s family of changes in Doris Beard’s condition. Calloway argues that the defendant intentionally made a number of material misrepresentations with the intention to induce reliance. The complaint states that Harborview is ultimately guilty for vicarious liability and gross negligence. Calloway is seeking damages for humiliation, mental anguish, emotional distress, loss of companionship, and loss of inheritance. Galveston County 10th District Court Judge David Garner will be presiding over the case.
