Woman sues UP over husband’s heart attack death |

MARSHALL – A woman is suing Union Pacific, the employer of her husband Calvin Boyd who died on the job from a heart attack, claiming that the company is responsible for the death of her partner. Brenda Boyd alleges that Union Pacific Corp. violated the Federal Employer’s Liability Act and several federal safety regulations. She has filed a lawsuit in the Marshall Division of the Eastern District of Texas on August 24. According to the lawsuit, Calvin Boyd was working with the company as a machine operator. On December 3, 2007, Boyd notified his supervisor that he was not feeling well. The supervisor, who was the only other employee working at that time, noticed Boyd had vomited all over his machinery. The supervisor asked Boyd to sit and take rest in the shade, and to drink some water. The suit says that Boyd had he had suffered complete cardiac arrest by the time he was transported to the closest hospital. The man had died before reaching the hospital, the suit states. Brenda argues that her husband’s death was caused by the negligence of Union Pacific. The lawsuit states that the company was negligent for violating the Federal Employers’ Liability Act, failing to provide Boyd with proper assistance to carry out his assigned duties, failing to provide him with proper and essential medical care and failing to use due care and concern under the circumstances. Brenda is seeking damages for mental anguish, medical expenses, funeral and burial expenses, lost earnings, loss of earning capacity, and loss of consortium. U.S. District Judge T. John Ward will be presiding over the case.
