Contractor Wins Malpractice Lawsuit

PROVIDENCE – A Warwick contractor, who claimed he suffered brain damage due to improper caring after having an open hear surgery at Rhode Island Hospital in 1998, has been awarded $2 million.

Richard T. Barrett, 59, was living in East Greenwich at the time of the surgery. He sued Rhode Island Hospital and Dr. William C. Feng, alleging that he received a low amount of oxygen to his brain due to mismanaged care.

According to the lawsuit, the damage rubbed out certain memories of his children, severely affected his ability to form fresh memories, impeded his ability to make complex decisions and impaired his ability to communicate.

Following nearly two days of deliberation and a 19-day trial before Judge Netti C Vogel, Barrett was awarded $2 million on Friday by a superior court jury. As per court documents, the award will total up to $3.6 million when the interest is included.

Barrett expressed his satisfaction over the verdict and said that justice was done.

 “I really feel vindicated and I want to thank the jury for approaching their jobs with an open mind and for the respect they showed to the judge and to me as a fellow citizen,” Barrett said.

According to the hospital’s lawyer, the care given by the hospital was “excellent”.

“We are exceptionally disappointed over the verdict,” he said.

The hospital is planning to file a motion for a new trial. And if even that is also denied, they will pursue an appeal to the U.S. Supreme Court.
