Dixie Dance Hall Sued for Causing Accident by Serving Drinks to Underaged Driver

The daughter and parents of a Texas man killed in a car crash are suing the bar for selling alcohol to the underaged driver.

It was on November 27 that Michael Slay Chapman died when the vehicle in which he was riding was struck by a vehicle driven by 19-year-old Bo Pillsbury. Before the accident, Pillsbury had been drinking at the Dixie Dance Hall in Beaumont's Crockett Street Entertainment District.

A lawsuit was filed by Chapman’s parents, Wayne and Teresa Chapman, and his daughter, Zoe Jane Chapman, against Dixie Host Ltd. on Feb. 1 in Jefferson County District Court.

The complaint states that employees of the defendant continued to serve Bo Pillsbury alcohol even after he was showing obvious signs of intoxication. The suit also alleges that Bo Pillsbury was allowed to leave the premises and drive away after drinking for an extended period of time at the Dixie Dance Hall.

“He lost control of his vehicle and struck a vehicle in which Michael Slay Chapman was a passenger because Bo Pillsbury was in an intoxicated state,” the complaint states.

The plaintiffs allege that the bar and its employees were negligent for allowing 19-year-old Pillsbury to be served alcohol when the legal drinking age in Texas is 21 years.

The plaintiffs are asking for compensation for loss of Chapman's companionship, society, love, comfort, care, maintenance, support, services, advice and counsel, in addition to the mental anguish they suffered as a result of Chapman’s death. Chapman’s family is seeking unspecified damages, in addition to costs, pre and post judgment interest and any other relief to which they may be entitled.

Judge Milton Shuffield, 136th District Court, has been assigned the case.
