Man Sues Wal-Mart Pharmacy for Dispensing Wrong Medication

A Jasper County man is suing Wal-Mart Stores Texas, Wal-Mart Pharmacy and pharmacist Cindy Lee Carranza, claiming that he required hospitalization after the pharmacy gave him another patient’s medication.

Emile Joseph Nini has filed a lawsuit against the defendants on 30th April in Jefferson County District Court.

According to 77-year-old Nini, Carranza, a pharmacist at Wal-Mart, gave him another patient’s medication on March 25, 2008. Nini took the medication and became ill. Nini suffered bodily injury and was hospitalized, according to the lawsuit.

Due to the incident, Nini incurred medical expenses for his injuries, experienced physical pain and suffering and sustained mental anguish and physical impairment, the complaint states.

Nini argues that the defendants  negligently failed to appropriately dispense the prescribed drug, failed to abide by the policies designed to prevent accidental dispensing of medication to the wrong patient, failed to inform him when they found he had another patient’s medication, failed to properly communicate essential information to him, failed to provide the same care and treatment that a reasonable pharmacy would have and failed to employ suitable policies and procedures relating to the dispensing of medicine.

Nini is seeking a judgment within the jurisdictional limits of the Court, in addition to pre- and post-judgment interest, costs and other relief that the court deems appropriate.

Judge Gary Sanderson, 60th District Court, will be presiding over the case.
